How to declare your crypto to the Spanish tax office in 2027 (2026 tax year)

A clear guide to Spain's 2026 income tax return: which crypto transactions are taxed, savings income brackets, FIFO, staking, form 721 and what DAC8 changes.

In spring 2027, Spanish residents file their income tax return for the 2026 tax year. It is the first campaign in which the Spanish tax office (Agencia Tributaria) will automatically receive data from European exchanges under DAC8, so it pays to arrive with your numbers done. At DEXT FORCE 2025, Sandra Adrián’s talk was precisely about what the tax office already knows about your crypto (DF25 recap). This guide covers the essentials.

This article is for information only and is not tax advice. Rules can change: check the official Agencia Tributaria guidance before filing.

What is taxed and what isn’t

  • Buying crypto with euros is not taxed.
  • Selling crypto for euros creates a capital gain or loss.
  • Swapping one crypto for another (for example, BTC for ETH or a stablecoin) is also a taxable event, even if no euros are involved.
  • Paying for goods or services with crypto counts as a sale.
  • Moving crypto between your own wallets or exchanges is not taxed, but keep the records to prove the origin.

How the gain is calculated

The gain is the difference between the sale value and the purchase value, including fees. To determine which units you sell, Spain uses FIFO: the first units you bought are the first you sell. If you trade on several exchanges, you need a complete history of every transaction for the numbers to add up.

How much you pay: savings income brackets

Gains from selling or swapping crypto go into the savings income base of Spanish income tax (IRPF):

Gain Rate
Up to €6,000 19%
€6,000 to €50,000 21%
€50,000 to €200,000 23%
€200,000 to €300,000 27%
Over €300,000 30%

Losses offset gains of the same type in the same year and, if any remain, in the following four years.

Staking, airdrops and mining

  • Staking and lending: the Spanish tax authority’s rulings generally treat them as income from movable capital, which also goes into the savings base.
  • Airdrops: rulings usually treat them as a capital gain not derived from a sale, taxed in the general base (the same as salary).
  • Mining: if regular and organised, it may be considered a business activity.

Each case has nuances. If the amounts are significant, talk to a professional.

Information returns: form 721

If on 31 December 2026 you held crypto held in custody by platforms outside Spain worth more than €50,000, you must file form 721 between 1 January and 31 March 2027. It is informational: nothing to pay, but not filing it can lead to penalties. Crypto in your own wallet (self-custody) is not included in form 721.

What DAC8 changes

Since 1 January 2026, the EU’s DAC8 directive requires crypto-asset service providers operating in the EU to collect and report their clients’ data and transactions to tax authorities. From 2027, the Spanish tax office can cross-check that data with your return. In practice: if you sold or swapped crypto in 2026, it should be in your return.

Checklist before filing

  1. Download the full transaction history from every exchange and wallet you used in 2026.
  2. Calculate gains and losses with FIFO (by hand or with crypto tax software).
  3. Separate sales and swaps (savings base), staking (movable capital) and airdrops.
  4. Check whether you need to file form 721 (before 31 March 2027).
  5. Review the tax data the Agencia Tributaria provides and compare it with your calculations.
  6. Keep all documentation for at least four years.

A proposal worth watching

In late 2025, the Sumar parliamentary group proposed moving gains on some crypto-assets into the general income tax base, with rates of up to 47%. As of this article it has not been approved, but it is worth following.
